Terms of Service

1. Acceptance of Terms

By creating an account, downloading, accessing, or using the Labeebee mobile application ("App," "Service," or "Labeebee"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use Labeebee.

For Users Under 18:

If you are under 18 years of age, a parent or legal guardian must agree to these Terms on your behalf. By using Labeebee, the parent or guardian confirms they are at least 18 years old and have the authority to bind the minor to these Terms.

These Terms constitute a legally binding agreement between you and A.C.N. 640 377 457 PTY LTD ("Labeebee," "we," "us," or "our").

2. Service Description

Labeebee is a sleep science-informed mobile app that generates personalized bedtime stories for children ages 3-10 (expanding to 11-14 in future updates) using AI technology. The Service includes:

• 5 demo stories (no account needed)
• AI-powered personalized story generation using Anthropic's Claude API
• Multi-chapter stories (3-7 chapters, Premium/Family only)
• 50+ professional stock voices with diverse ages, genders, and accents
• Voice cloning (Premium/Family only)
• Professional voice narration (text-to-speech) using ElevenLabs or PlayHT
• Story library for saving and replaying generated stories
• Ambient visual themes (space, ocean, forest, fantasy, calm)
• Child profile creation with Story DNA preference system
• Custom character creation for personalized stories
• Interactive story choices (mid-story decision points)
• Karaoke mode with word-level highlighting (Premium/Family only)
• Offline downloads (Premium/Family only)
• Subscription-based access with trial and free tier options

The Service is designed as a bedtime sleep solution, not entertainment. We use sleep science-informed story structures to help children transition to sleep.

3. Eligibility and Account Registration

Age Requirement:

• You must be at least 18 years old to create a Labeebee account
• Parents or legal guardians create accounts on behalf of children
• Children under 13 may not create accounts independently

Account Security:

• You are responsible for maintaining the confidentiality of your login credentials
• You must provide accurate and complete information during registration
• You agree to notify us immediately of any unauthorized account access at support@labeebee.app
• You are responsible for all activities that occur under your account

Child Profiles:

• Parents are responsible for monitoring their child's use of Labeebee
• Parental controls (parent gate) protect settings, purchases, and data access
• Parents may create up to 5 child profiles (Premium) or 10 profiles (Family Plan)

4. Intellectual Property Rights

AI-Generated Content Ownership

Stories Generated for You:

• Stories generated by Labeebee are licensed to you for personal, non-commercial use only
• You may NOT sell, distribute, publicly perform, or commercially exploit generated stories
• You may NOT create derivative works of generated stories for commercial purposes
• You may share stories with family members within your household
• You may listen to stories offline on authorized devices linked to your account

Your Inputs and Content:

• You retain ownership of content you provide (child names, character descriptions, preferences, ratings)
• You grant Labeebee a non-exclusive, worldwide, royalty-free license to use your inputs solely for the purpose of generating personalized stories for your account
• This license terminates when you delete your account or the specific content

Voice Recordings (Voice Cloning):

• You retain ownership of voice recordings you provide
• You grant Labeebee a perpetual license to use voice recordings solely for generating voice narration for stories within the app
• You acknowledge that ElevenLabs processes voice recordings per their Terms of Service
• Voice models are deleted upon account deletion or explicit request
• Family members who submit voice recordings via invitation portal grant the same license

Labeebee Intellectual Property:

• The Labeebee app, algorithms, Story DNA system, user interface, design, and all proprietary technology remain the exclusive property of A.C.N. 640 377 457 PTY LTD
• Labeebee trademarks, logos, and branding are protected intellectual property
• You may NOT reverse engineer, decompile, disassemble, or extract source code from Labeebee
• You may NOT copy, modify, or create derivative works of Labeebee technology

5. Prohibited Uses

You agree NOT to:

• Share your account credentials with anyone outside your household
• Use generated stories for commercial purposes (selling, distribution, public performance)
• Reverse engineer, decompile, or attempt to extract source code from the app
• Use automated tools, bots, or scripts to generate excessive stories or abuse the Service
• Attempt to circumvent parental controls or access restrictions
• Attempt to bypass tier limitations through multiple accounts
• Misuse voice cloning feature (unauthorized recording of others, impersonation, recording children's voices without consent)
• Submit copyrighted character names or trademarked content for story generation
• Create offensive, harmful, or inappropriate content through character creation or story customization
• Violate any applicable local, state, national, or international laws
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity, or misrepresent your affiliation
• Collect or harvest any personally identifiable information from other users
• Use the Service in any manner that could damage, disable, overburden, or impair Labeebee infrastructure

Violation of these Prohibited Uses may result in immediate account suspension or termination without refund.

6. Subscription Terms

Free Trial

• Duration: 7-day free trial with full Premium access
• Activation: Trial begins when you create your first child profile
• Extension: One-time 7-day extension available for low-engagement users (2 stories or fewer by day 6)
• Cancellation: Cancel anytime during trial to avoid charges
• No Credit Card Required: Trial does not require payment method (managed through App Store/Play Store)

Post-Trial Free Tier

• Allowance: 2 personalized stories per month
• Reset: Monthly allowance resets on the 1st of each month (not anniversary date)
• Demo Stories: 5 pre-generated demo stories available anytime (no account required)
• Limitations: Free tier does not include voice selection, offline downloads, or interactive story choices

Standard Subscription ($4.99/month or $39.99/year)

• Monthly Plan: $4.99/month
• Annual Plan: $39.99/year (save 33%, equivalent to $3.33/month)

Payment Processing

• Subscriptions are charged through Apple App Store or Google Play Store
• Billing is managed by Apple/Google, not Labeebee directly
• Payment methods are stored by Apple/Google per their payment policies
• Labeebee does not have access to your credit card information

Auto-Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Renewal charges are the same as the original subscription price (unless you receive notice of price change)

Managing Your Subscription

To Cancel or Modify:

• iOS: Settings → [Your Name] → Subscriptions → Labeebee → Cancel Subscription
• Android: Play Store → Menu → Subscriptions → Labeebee → Cancel Subscription
• In-App: Labeebee Settings → Subscription → Manage (opens App Store/Play Store)

Refund Policy

• No refunds are provided for partial billing periods
• If you cancel mid-billing period, you retain premium access until the end of that period
• Exceptional circumstances (technical issues, billing errors): Contact support@labeebee.app
• App Store/Play Store refund policies may apply - contact Apple/Google Support directly

Price Changes

• We reserve the right to change subscription pricing with 30 days' notice
• Current subscribers are grandfathered at their current price for the remainder of the billing period
• Price changes take effect on your next renewal date after notice period
• You may cancel before price change takes effect to avoid new pricing

7. Service Modifications and Termination

Right to Modify Service:

• We may modify, suspend, or discontinue any feature or aspect of the Service at any time
• We will provide 30 days' notice for material changes that significantly reduce functionality
• New features may be added without notice
• We are not liable for any modification, suspension, or discontinuation

Account Suspension or Termination:

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• You engage in prohibited uses (see Section 5)
• You provide false or misleading information
• Your account remains inactive for 24 months
• We are required to do so by law

Termination for Terms violations does NOT entitle you to a refund. You may request account deletion at any time via Settings or by contacting support@labeebee.app.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

Specifically, Labeebee Does NOT Warrant:

• Uninterrupted or error-free service (we strive for 99.9% uptime but cannot guarantee it)
• Quality, appropriateness, or suitability of AI-generated stories for every child
• Absence of bugs, errors, or technical issues
• Compatibility with all devices or operating system versions
• Accuracy, reliability, or completeness of AI-generated content
• Specific sleep outcomes or behavioral improvements

AI-Generated Content Disclaimer:

• Stories are generated by AI (Anthropic's Claude API) and may occasionally produce unexpected or imperfect results
• Parents are responsible for reviewing generated stories before presenting them to children
• AI content is not a substitute for parental judgment or human-authored content

Not a Medical Device or Service:

• Labeebee is NOT a medical device and is not intended to diagnose, treat, cure, or prevent any disease or condition
• Labeebee is NOT a substitute for professional medical advice, diagnosis, or treatment
• If your child has sleep disorders, behavioral issues, or developmental concerns, consult a qualified healthcare provider

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LABEEBEE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, A.C.N. 640 377 457 PTY LTD AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

• Indirect, Incidental, or Consequential Damages including lost profits, data loss, loss of goodwill, or business interruption
• Special or Punitive Damages arising from your use of or inability to use the Service
• Damages Resulting From:
  • Errors, mistakes, or inaccuracies in AI-generated content
  • Interruptions or cessation of Service
  • Unauthorized access to your account or data
  • Third-party content or conduct
  • Bugs, viruses, or other harmful components

Total Liability Cap:

In no event shall Labeebee's total liability to you for all claims arising from or related to the Service exceed the amount you paid to Labeebee in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless A.C.N. 640 377 457 PTY LTD, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to:

• Your use or misuse of the Service
• Your violation of these Terms of Service
• Your violation of any third-party rights, including intellectual property rights
• Your violation of any applicable laws or regulations
• Content you submit to Labeebee (character names, voice recordings, etc.)
• Any false or misleading information you provide

This indemnification obligation survives termination of these Terms and your use of the Service.

11. Dispute Resolution

Governing Law:

These Terms are governed by the laws of Queensland, Australia without regard to conflict of law provisions.

Informal Resolution:

Before filing any claim, you agree to contact support@labeebee.app to attempt to resolve the dispute informally. We will make a good-faith effort to resolve disputes within 30 days.

Jurisdiction and Venue:

Any disputes arising from these Terms or the Service shall be resolved in the courts of Queensland, Australia. You consent to the personal jurisdiction and venue of such courts.

No Class Actions:

You agree to resolve disputes on an individual basis only, and NOT as part of a class action, consolidated action, or representative action.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

13. Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and A.C.N. 640 377 457 PTY LTD regarding your use of Labeebee. These Terms supersede all prior agreements, understandings, or communications, whether written or oral.

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

We may update these Terms from time to time. Material changes will be communicated via email and in-app notification with 30 days' notice. Continued use after changes take effect constitutes acceptance of the updated Terms.

16. Demo Stories Terms

• Access: 5 pre-generated demo stories accessible without account creation
• Limitations: Demo stories feature generic characters and cannot be personalized
• Purpose: Evaluation of service quality before account creation
• No guarantees: Demo story availability not guaranteed indefinitely

17. Multi-Chapter Stories

• Serial generation: Chapters generated on-demand as child progresses
• Incomplete series: If subscription lapses or is cancelled, incomplete series may remain unfinished
• Tier requirement: Multi-chapter stories require Standard, Premium, or Family subscription
• Chapter limits: Series range from 3-7 chapters depending on story complexity

18. Voice Cloning Terms

• Consent required: You may only record your own voice or voices you have explicit consent to record
• Prohibited: Recording children's voices, unauthorized impersonation, recording others without consent
• Family invitations: You may invite family members to record their voices via secure invitation portal
• Data sharing: Voice recordings are processed by ElevenLabs for voice model creation
• Deletion: Voice clones deleted upon account deletion, or can be deleted individually via Settings
• Premium feature: Voice cloning requires Premium or Family subscription
